What are the timing deadlines that need to be observed by both parties?
1.Deadlines for the operator
1. If a windscreen ticket is issued following an alleged PCN and the PCN remains unpaid after 28 days:
- The Operator must send a notice to the registered keeper between 28 and 56 days after the incident.
2. If an Automated Number Plate Recognition issued the PCN:
- The Operator must send a “notice to keeper” within 14 days of the infringement.
3. If an Operator receives a written appeal regarding a PCN, the Operator must both:
- Acknowledge the appeal with 14 days of receiving the appeal.
- And, within 35 days of receiving the appeal, decide to accept or reject the appeal and notify the person who made the appeal of the result.
2. Deadlines for the driver
1. If a driver receives a windscreen ticket and wants to take the option of receiving the 40% early payment discount
- The driver must pay the ticket within 14 days.
2. If a driver received a windscreen ticket and wants to and the driver wants to have the right to appeal to POPLA:
- The driver must firstly appeal to the Operator within 28 days of receiving the notice posted to them by the Operator.
3. If a driver is nominated by the Registered Keeper and the driver wants to have the right to appeal to POPLA:
- The driver must firstly appeal to the Operator within 28 days of receiving the notice posted to them by the Operator.
4. If the driver’s appeal to the Operator is unsuccessful and the driver wants to appeal to POPLA:
- The driver must lodge their appeal with POPLA within 28 days of receiving the reject notice from the operator.
3. Deadlines for the registered keeper
1. If the registered keeper receives a PCN by mail from an Operator and the registered keeper wants to nominate a driver to take responsibility for the PCN, then:
- The registered keeper should notify the Operator of the name and address of the driver within 28 days of receiving the notice. However, I don’t think this is a “hard” deadline and, in practice, the registered keeper can nominate the driver at any stage in the process.
2. If the registered keeper receives a notice from an Operator and the registered keeper wants to have the right to appeal to POPLA:
- The Registered Keeper must firstly appeal to the Operator within 28 days of receiving the notice posted to them by the Operator.
3. If the register keeper’s appeal to the Operator is unsuccessful and the registered keeper wants to appeal to POPLA:
- The registered keeper must lodge their appeal with POPLA within 28 days of receiving the reject notice from the operator.
